What:

Created to help industry understand a complex body of material, the presentation discusses the knowledge and content that you, as industry need to be able to work effectively when dealing with these multifaceted issues. The aim of the presentation is to provide a practical understanding of the legal and policy imperatives of working with Indigenous people in BC including but not limited to the constitutional and legislative framework and the BC Oil and Gas Commission's mandate.

Topics Include:

• The historic narrative and constitutional framework
• An overview of the case law and key legal concepts from the last 40 years
• Understanding historic treaties - the context, perspectives and contemporary realities
• "Section 35" - understanding its purpose, framework and emerging issues
• Addressing overlapping territories, private lands, etc.
• The duty to consult and accommodate - its origins, recent case law developments and current trends
• The Crown, Proponent and Aboriginal perspectives on the duty to consult and accommodate
• An overview of the United Nations Declaration of Indigenous Peoples, Truth and Reconciliation Commission Call to Action, BC/Commission Mandates and the BC Draft Principles
• Communicate important information regarding the Blueberry River First Nations litigation including the Adjournment Agreement, RSEA IMs, and Application Process

Instructors will be provided by the BC Oil and Gas Commission.
